The Senate Judiciary Committee has advanced the nomination of a 38-year-old judge and ally of Senate Majority Leader Mitch McConnell to serve on a federal appeals court, despite Democrats’ objections that he’s inexperienced and biased against the Obama health care law.
The panel's 12-10, party-line vote Thursday sets the stage for Justin Walker’s likely confirmation in the GOP-controlled Senate.
Walker, a protege of both McConnell and Supreme Court Justice Brett Kavanaugh, told senators last month that he will have an open mind on the Affordable Care Act, adding that he was writing as an academic and commentator when he criticized as “indefensible” a Supreme Court ruling upholding the law.
Walker, who was confirmed as a federal judge last fall, declined a request by Senate Democrats to recuse himself on matters related to the health care law if he’s confirmed to the U.S. Court of Appeals for the District of Columbia Circuit. The court is widely considered the second-most powerful in the nation and frequently serves as a launching pad for a seat on the Supreme Court. Four current justices, including Kavanaugh, served on the D.C. circuit.
Sen. Dick Durbin of Illinois, the No. 2 Senate Democrat, called Walker's nomination a travesty and an affront to other, more qualified conservative judges. |

Lawyer: Security video in Arbery case may show water breaks

A young black man filmed by a security camera walking through a home under construction in December and in February may have stopped at the site for a drink of water, according to an attorney for the homeowner thrust into the investigation of the fatal shooting of Ahmaud Arbery.
Arbery was killed Feb. 23 in a pursuit by a white father and son who armed themselves after the 25-year-old black man ran past their yard just outside the port city of Brunswick. Right before the chase, Arbery was recorded inside an open-framed home being built on the same street.
Gregory McMichael, 64, and Travis McMichael, 34, have been jailed on murder charges since May 7. The elder McMichael told police he suspected Arbery was responsible for recent break-ins in the neighborhood. He also said Arbery attacked his son before he was shot.
Arbery’s mother has said she believes her son was merely out jogging.
On Friday, an attorney for the owner of the house under construction released three security camera videos taken Dec. 17, more than two months before the shooting. They show a black man in a T-shirt and shorts at the site. In the final clip, he walks a few steps toward the road, then starts running at a jogger's pace.
“It now appears that this young man may have been coming onto the property for water,” J. Elizabeth Graddy, the attorney for homeowner Larry English, said in a statement. “There is a water source at the dock behind the house as well as a source near the front of the structure. Although these water sources do not appear within any of the cameras’ frames, the young man moves to and from their locations.”
A man in similar clothes appears briefly in another security video taken at the home construction site Feb. 11, less than two weeks before the shooting. Graddy said that person appears to be the same man shown in the Dec. 17 videos. |

Hawaii Judiciary postpones state court trials amid pandemic

Hawaii Chief Justice Mark Recktenwald has announced an order to postpone all state court trials amid the coronavirus pandemic, the state Judiciary said.
The order states all state trials in civil, criminal and family courts be postponed until May 29 or the termination of Gov. David Ige’s state of emergency, whichever is sooner, the Honolulu Star-Advertiser reported.
The exception would be if the chief judge of a circuit court orders otherwise.
“While our community has responded well to stay-at-home orders and the results of these public health measures have been encouraging, the Judiciary must continue to do our part to protect the health and safety of our court personnel and court users," Recktenwald said.
The Committee on Operational Solutions was also formed under the order. The committee would accelerate the courts’ capabilities to conduct proceedings remotely due to the pandemic and would plan for the timely transition to return to increased court operations in the coming months.
Recktenwald has encouraged teleconferencing and videoconferencing to address as many cases as possible and appropriate to combat the spread of COVID-19. |

Court approves PG&E’s $23B bankruptcy financing package

Pacific Gas & Electric on Monday won court approval to raise $23 billion to help pay its bills over destructive California wildfires after Gov. Gavin Newsom dropped his opposition to a financing package designed to help the nation’s largest utility get out of bankruptcy.
The milestone reached during an unusual court hearing held by phone moves PG&E closer to its goal of emerging from one of the most complex bankruptcy cases in U.S. history by June 30.
Newsom has said he fears P&E is taking on too much debt to be able to afford an estimated $40 billion in equipment upgrades needed to reduce the chances of its electricity grid igniting destructive wildfires in the future.
The utility’s outdated system triggered a series of catastrophic wildfires in 2017 and 2018 that killed so many people and burned so many homes and businesses that the company had to file for bankruptcy early last year.
But the recent volatility in the financial markets caused by the coronavirus pandemic apparently softened Newsom’s stance after PG&E lined up commitments from investors promising to buy up to $12 billion in company stock.

Australian highest court to rule on Cardinal’s appeal later

Australia’s highest court on Thursday said it will deliver a verdict at a later date on whether to overturn the convictions of the most senior Catholic to be found guilty of child sex abuse.
Cardinal George Pell’s lawyer, Bret Walker, told the High Court that if it found a lower court had made a mistake in upholding Pell’s convictions, he should be acquitted.
Prosecutor Kerri Judd told the seven judges that if there were a mistake, they should send the case back to the Victoria state Court of Appeal to hear it again.
Otherwise, the High Court should hear more evidence and decide itself whether the convictions against Pope Francis’ former finance minister should stand, Judd said.
Pell is one year into a six-year sentence after being convicted of molesting two 13-year-old choirboys in Melbourne’s St. Patrick’s Cathedral while he was the city’s archbishop in the late 1990s.
The 78-year-old cleric’s two-day hearing that ended on Thursday could be his last chance of clearing his name.
Pell was largely convicted on the testimony of one of the choirboys, now in his 30s with a young family.

Trump ally Roger Stone sentenced to over 3 years in prison

Roger Stone, a longtime confidant of President Donald Trump, was sentenced to more than three years in prison Thursday for obstructing a congressional investigation in a case that has sparked fears about presidential interference in the justice system.
Soon after Judge Amy Berman Jackson pronounced sentence, Trump publicly decried Stone’s conviction as unfair and prominent Republican legislators were giving tacit support for a pardon. But Trump said he wasn’t ready to act just yet.
“I want the process to play out. I think that’s the best thing to do because I would love to see Roger exonerated,” he said. “I’m going to watch the process. I’m going to watch very closely. … At some point I’ll make a determination.”
The case was marked by the Justice Department’s extraordinary about-face on a sentencing recommendation and a very public dispute between Trump and Attorney General William Barr, who said the president was undermining the department’s historical independence and making “it impossible for me to do my job.”
The president responded by asserting that he was the “chief law enforcement officer of the federal government.”
Stone was convicted in November on all seven counts of an indictment that accused him of lying to Congress, tampering with a witness and obstructing the House investigation into whether the Trump campaign coordinated with Russia to tip the 2016 election.
He was the sixth Trump aide or adviser to be convicted on charges brought as part of special counsel Robert Mueller’s investigation into possible Russian interference in the 2016 election. |
