7 now guilty in Pendleton contractor bribery case

Two civilian defense contractors have pleaded guilty in a San Diego federal court, bringing to nine the number of defendants who have admitted guilt in recent days to their involvement in a scheme involving bribes and kickbacks at Camp Pendleton and other federal facilities.
Federal prosecutors say Paul Dana Kay of PK Excavation and Manuel Ramirez of MRN Construction, Inc., entered the pleas to violations of the Anti-Kickback Act on Friday.
Six former contractors and a former Defense Department employee have pleaded guilty in the past two weeks to involvement in the scheme.
They include Natividad Lara Cervantes, who referred to himself as "The Godfather of Camp Pendleton," and admitted accepting bribes.
Sentencing is scheduled for April. The defendants face maximums ranging from three years to 20 years in prison.

2 killed in attack at German court

Two men were killed Friday in a shooting and stabbing at a court complex in Frankfurt in what may have been a revenge attack, authorities said.
Frankfurt prosecutors said the case appeared to be linked to the fatal stabbing of a car dealer near Frankfurt in 2007, which the court was considering this week, news agency dpa reported.
Deputy police chief Gerhard Bereswill said the suspected assailant is believed to be the brother of the 2007 victim and was injured himself in the earlier attack, while the two men who died Friday — who also were car dealers — were suspects.
The suspect is believed to have fired shots in a courtyard at the courthouse in the German financial capital at about 8:45 a.m., fatally wounding one of the victims. The other apparently fled inside the building, but the assailant followed and stabbed him, police spokesman Ruediger Reges told N24 television.
The two victims were aged 45 and 50. One died at the scene and the other shortly afterward at a hospital, police said.
The suspected attacker fled on foot but was arrested near the courthouse, he said. A police statement said he was a 47-year-old Afghan national and resident of Eschborn, a town near Frankfurt. |

Court hearings for 2 arrested in student stabbing

A 23-year-old man and a 16-year-old boy arrested in the stabbing of a Seattle University student have been ordered held after initial court appearances.
The Seattle Times reports that bail for the man was set Thursday at $1 million while the teen was ordered held in juvenile custody. Prosecutors say they expect to file charges Friday.
A 16-year-old girl arrested in the attack early Wednesday was released pending further investigation.
The suspects were arrested for investigation of robbery and assault. Police allege they followed a 23-year-old student, pushed him to the ground and stabbed him in the chest. He called for help from an emergency kiosk on campus. The student was hospitalized in serious condition. |

Court weighs president's recess appointments power

The Supreme Court is refereeing a politically charged dispute between President Barack Obama and Senate Republicans over the president's power to temporarily fill high-level positions.
The case being argued at the high court Monday is the first in the nation's history to consider the meaning of the provision of the Constitution that allows the president to make temporary appointments to positions that otherwise require Senate confirmation, but only when the Senate is in recess.
The court battle is an outgrowth of increasing partisanship and the political stalemate that's been a hallmark of Washington for years, and especially since Obama took office in 2009.
Senate Republicans' refusal to allow votes for nominees to the National Labor Relations Board and the new Consumer Financial Protection Bureau led Obama to make the temporary, or recess, appointments in January 2012.
Three federal appeals courts have said Obama overstepped his authority because the Senate was not in recess when he acted.
The Supreme Court case involves a dispute between a Washington state bottling company and a local Teamsters union in which the NLRB sided with the union. The U.S. Court of Appeals for the District of Columbia Circuit overturned the board's ruling. Hundreds more NLRB rulings could be voided if the Supreme Court upholds the appeals court decision. |

Supreme Court Puts Utah Same-Sex Marriage on Hold

The Supreme Court on Monday put same-sex marriages on hold in Utah, at least while a federal appeals court more fully considers the issue.
The court issued a brief order blocking any new same-sex unions in the state.
The order grants an emergency appeal by the state following the Dec. 20 ruling by U.S. District Judge Robert Shelby that the state's ban on same-sex marriage violates gay and lesbian couples' constitutional rights.
More than 900 gay and lesbian couples have married since then.
The high court order will remain in effect until the Denver-based 10th U.S. Circuit Court of Appeals decides whether to uphold Shelby's ruling.
The state's request to the Supreme Court was filed with Justice Sonia Sotomayor, who handles emergency appeals from Utah and the five other states in the 10th Circuit. Sotomayor turned the matter over to the entire court.
The action now shifts to Denver, where the appeals court will consider arguments from the state against same-sex marriage as well as from the three gay and lesbian couples who challenged the ban in support of Shelby's ruling. The appeals court had twice rebuffed the state's plea to stop gay weddings pending appeal. |

Serial rapist Coe appeals confinement in US court

Kevin Coe, who was arrested in 1981 after dozens of women were raped in Spokane, is appealing his confinement as a sexually violent predator to federal court.
Coe was suspected in the rapes, attributed to the "South Hill Rapist," but only one conviction stood against him. He served 25 years in prison, and was confined at the state's Special Commitment Center on McNeil Island in 2008, following a monthlong civil trial.
Coe argues that the jurors at his civil trial should not have been asked to determine that he suffered from a "personality disorder" without having that term defined for them. He also says the jury should not have heard evidence of the other cases linked to the South Hill rapist because he was never convicted of them and because he was not allowed to challenge some of the victims through cross-examination.
The state Supreme Court rejected those arguments in 2012.
On Monday, a federal magistrate judge recommended that Coe's request to proceed as an indigent plaintiff be rejected. The judge found that Coe can afford to pay the fee required to file the case.
