Court orders Turkey to pay Cyprus over invasion

Europe's top human rights court on Monday ordered Turkey to pay 90 million euros ($123 million) to Cyprus over the 1974 invasion of the island and its subsequent division, in one of the largest judgments in its history. The decision from the European Court of Human Rights said the passage of time did not erase responsibility in the case, ruling that Turkey must pay 30 million euros in damages to relatives of those missing in the operations and 60 million euros in damages for "the enclaved Greek-Cypriot residents of the Karpas peninsula." Cyprus has been divided since Turkey invaded after a coup by supporters of union with Greece. Only Turkey recognizes the breakaway Turkish Cypriot state that was proclaimed in the north of the island. The judgment comes as the Turkish and Greek Cypriot communities are engaged in a new effort to reunite the island. The court said it would be up to the government of Cyprus to determine how to award the damages. |

Oklahoma court agrees to 6-month stay of execution

The Oklahoma Court of Criminal Appeals agreed Thursday to a six-month stay of execution for a death row inmate while an investigation is conducted into last week's botched lethal injection.
The court reset the execution date of inmate Charles Warner to Nov. 13. Warner's attorneys requested the 180-day delay, and the state Attorney General Scott Pruitt said Thursday in a court filing he wouldn't object.
While the stay only applies to Warner, Pruitt and Gov. Mary Fallin have said the state will not carry out any executions until the investigation is complete, which is expected to take at least eight weeks.
"If the state is allowed to enforce the ultimate penalty of death, it is incumbent upon this court to allow the state the time necessary to ensure that the penalty is carried out in a constitutionally sound manner," Justice Charles Johnson wrote in a specially concurring opinion.
Warner was scheduled for execution on the same night last week as Clayton Lockett in what would have been the state's first double execution since 1937. But Lockett's vein collapsed during his lethal injection, prompting prison officials to halt the execution. He later died of a heart attack. |

Casino law hinges on Massachusetts high court case

The fate of casino gambling in Massachusetts may hinge on a case before the state's highest court Monday.
The Massachusetts Supreme Judicial Court is set to hear arguments in a case centered on whether a question should be allowed on the November ballot asking voters if they want the state's 2011 casino law repealed. The court is expected to issue a decision by July.
If allowed on the ballot, the referendum could upend the state's ongoing casino licensing process.
Gambling giants MGM, Wynn, Mohegan Sun and others have expressed concern they could lose millions of dollars they've invested in the planning, development and promotion of their proposals if the referendum prevails. They also argue the state risks losing much more.
"Jobs certainty and billions of dollars in economic development hang in the balance," said Carole Brennan, a spokeswoman for MGM, which has proposed an $800 million casino project in downtown Springfield. "The Gaming Act allows for the creation of more than 10,000 jobs and the recapture of billions of dollars in tax revenues that are currently leaving the state. It doesn't make sense to forgo those opportunities."
State Attorney General Martha Coakley, a Democrat running for governor this year, has ruled that the question violates the state constitution and shouldn't be allowed on the ballot. |

Lawsuit seeks access to more secret court opinions

The Obama administration has failed to turn over documents under public-records requests detailing still-secret court orders about the scope and legality of National Security Agency surveillance, according to a lawsuit filed Thursday in federal court.
The Electronic Frontier Foundation, a civil liberties group, said the Justice Department failed under its legally prescribed deadline to hand over documents in four requests since last year under the Freedom of Information Act. The requests sought, among other documents, secret opinions from the Foreign Intelligence Surveillance Court exploring whether the NSA violated the law in collecting Americans' Internet communications.
A Justice Department spokesman said Thursday that the agency was "committed to a transparent and open government, and makes every attempt to comply with Freedom of Information requests in a timely and efficient manner while ensuring that classified or sensitive information is not improperly released."
The lawsuit comes at a time when the president has promised to be more transparent on how the intelligence agencies conduct surveillance. As part of its response to the fallout from former NSA systems analyst Edward Snowden's disclosures, the administration has declassified hundreds of pages of documents regarding the secret surveillance programs, including many of the surveillance court opinions.
The Electronic Frontier Foundation has aggressively sought access to the secret court's records, and some recently disclosed documents were the result of those lawsuits. EFF's most recent FOIA requests, among those challenged Thursday in U.S. District Court in Washington, also sought opinions from the secret appeals court and, if any were to exist, at the Supreme Court. |
