Court drops rape, other charges against megachurch leader

A California appeals court ordered the dismissal of a criminal case Tuesday against a Mexican megachurch leader on charges of child rape and human trafficking on procedural grounds.
Naason Joaquin Garcia, the self-proclaimed apostle of La Luz del Mundo, has been in custody since June following his arrest on accusations involving three girls and one woman between 2015 and 2018 in Los Angeles County. Additional allegations of the possession of child pornography in 2019 were later added. He has denied wrongdoing.
While being held without bail in Los Angeles, Garcia has remained the spiritual leader of La Luz del Mundo, which is Spanish for “The Light Of The World.” The Guadalajara, Mexico-based evangelical Christian church was founded by his grandfather and claims 5 million followers worldwide.
It was not clear when he would be released. The attorney general’s office said it was reviewing the court’s ruling and did not answer additional questions. Garcia’s attorney, Alan Jackson, said he and his client are “thrilled” by the decision.

Supreme Court: Justices healthy and trying to stay that way

The Supreme Court reported Friday that the nine justices are healthy and trying to stay that way.
To that end, when the court held its regularly scheduled private conference Friday morning, some of the justices participated remotely, and those who were in the building did not engage in the tradition of shaking hands, court spokeswoman Kathy Arberg said.
The court plans to issue opinions Monday in cases argued during the fall and winter without taking the bench, Arberg said. The last time that happened was when the court decided Bush v. Gore late in the evening of Dec. 12, 2000, essentially settling the disputed 2000 presidential election in favor of Republican George W. Bush.
Arberg wouldn't say who showed up in person Friday to the justices' conference room, adjacent to Chief Justice John Roberts' office. Six of the nine justices are 65 and older, at higher risk of getting very sick from the illness, according to the Centers for Disease Control and Prevention. Justices Ruth Bader Ginsburg, who turned 87 on Sunday, and Stephen Breyer, 81, are the oldest members of the court.
Justice Brett Kavanaugh, 54, flew on a commercial flight last week between Washington, D.C., and Louisville, Kentucky, for a ceremony in honor of U.S. District Judge Justin Walker, a former law clerk whom President Donald Trump named to the federal bench last year. |

Fight over jaguar habitat in Southwest heads back to court

A federal appeals court is ordering a U.S. district judge in New Mexico to reconsider a case involving a fight over critical habitat for the endangered jaguar in the American Southwest.
Groups representing ranchers had sued, arguing that a 2014 decision by the U.S. Fish and Wildlife Service to set aside thousands of acres for the cats was arbitrary and violated the statute that guides wildlife managers in determining whether certain areas are essential for the conservation of a species.
With the order released this week, the 10th Circuit Court of Appeals overturned an earlier ruling that had sided with the Fish and Wildlife Service.
Jaguars are currently found in 19 countries. Several individual male jaguars have been spotted in Arizona and New Mexico over the last two decades but there's no evidence of breeding pairs establishing territories beyond northern Mexico.
Shrinking habitats, insufficient prey, poaching and retaliatory killings over livestock deaths are some of the things that have contributed to the jaguar’s decline in the Southwest over the past 150 years.
Under a recovery plan finalized last year, Mexico as well as countries in Central and South America would be primarily responsible for monitoring jaguar movements within their territory. Environmentalists have criticized the plan, saying the U.S. government is overlooking opportunities for recovery north of the international border.

Asylum Seekers Attend Border Court Amid Outbreak

U.S. immigration courts sharply scaled back operations Monday but have stopped well short of a total shutdown demanded by employees, including judges and government attorneys.
Wearing face masks, about 30 asylum seekers who had been waiting in Mexico were escorted by authorities into a federal building in El Paso, Texas, some carrying children.
They reported, as instructed, to a border crossing at 4 a.m. Monday and were driven to the court in white vans. Journalists were barred from the courtroom on the grounds that it was too crowded.
A lawyer who attended said the judge appeared by video conference, and few, if any migrants wore masks once the hearing began.
“All of the benches are taken up,” Imelda Maynard said. “Most of the children are asleep in their parent’s arms.”
The Justice Department’s Executive Office for Immigration Review late Sunday postponed preliminary hearings for people who aren’t in custody through April 10. While significant, the order doesn’t extend to courts in immigration detention centers or to the government’s “Migrant Protection Protocols” policy to make asylum seekers wait in Mexico for hearings in the U.S. It also didn’t apply to final hearings which determine whether migrants are granted asylum.

Lesotho's PM fails to show in court to face murder charge

Lesotho’s prime minister failed to show up in court on Friday to be charged with murder in the killing of his estranged wife, and police said he might have gone to neighboring South Africa for an undisclosed ailment.
Prime Minister Thomas Thabane's current wife, Maesaiah, also has been charged with murder in the 2017 death of Lipolelo Thabane. She had briefly fled the kingdom for South Africa, avoiding a police summons.
Deputy Commissioner of Police Paseka Mokete, who led the investigation, said he had heard rumors that the 80-year-old prime minister had gone to South Africa for a medical check-up.
“I have spoken to Thabane’s lawyer and he told me he is not aware of the prime minister’s whereabouts,” Mokete said. “We are now waiting for him to return so that he can be charged.”
It would be premature to seek an arrest warrant for the prime minister as police did when Maesaiah Thabane refused to honor a police summons last month, Mokete said.
On Thursday, Mokete confirmed to The Associated Press that the prime minister would appear at Maseru Magistrates Court to face a murder charge and an attempted murder charge in connection with a shooting of a friend of Lipolelo Thabane.
Thomas Thabane is the first sitting prime minister in Lesotho to be charged with any crime. He has announced he would step down by the end of July, if not sooner, amid pressure from the ruling party, which says he is no longer fit to rule.

WADA asks sports court to open Russia case to public hearing

The World Anti-Doping Agency wants a rare public hearing for sport’s highest court to judge a four-year slate of punishments faced by Russia for persistent cheating.
The Court of Arbitration for Sport is preparing a hearing expected within weeks for the blockbuster case in Switzerland.
“It is WADA’s view and that of many of our stakeholders that this dispute at CAS should be held in a public forum to ensure that everybody understands the process and hears the arguments,” the Montreal-based agency’s director general, Olivier Niggli, said in a statement.
Urged on by President Vladimir Putin, Russia’s anti-doping agency, known as RUSADA, is formally challenging a WADA ruling in December to declare it non-compliant after key data from the Moscow testing laboratory was corrupted.
The CAS panel of three judges will have power to enforce WADA-recommended sanctions including a ban on Russia’s team name, flag and anthem at Olympic Games and world championships.
WADA also wants Russian athletes to compete as neutrals at the Olympics and major events only if they pass a vetting process which examines their history of drug testing and possible involvement in lab cover-ups of positive tests.
CAS hearings can be opened to media and public observers in some cases when both parties consent.
The court held its first public hearing for 20 years in November when WADA appealed a ruling by swimming’s world body not to ban China’s three-time Olympic gold medalist Sun Yang for alleged doping rule violations.
